ArgonarPay ("we", "us", "our") is committed to protecting the personal information of our merchants and their customers. This Privacy Policy explains how we collect, use, store, and share your information when you use our payment gateway services ("Service").

This Policy is compliant with the Republic Act 10173 — Data Privacy Act of 2012 and its Implementing Rules and Regulations.

2. Information We Collect

We collect the following categories of information:

  • Account information: Full name, email address, contact number, business name, business type
  • Identity documents: Government-issued ID, selfie with ID, business permit (for KYC verification)
  • Payout account details: Bank or e-wallet name, account number, account holder name
  • Transaction data: Payment amounts, order references, timestamps, and status
  • Technical data: IP address, browser type, API request logs

3. How We Use Your Information

We use your information to:

  • Verify your identity and comply with KYC/AML requirements
  • Process and reconcile payments on your behalf
  • Send settlements to your registered payout account
  • Communicate service updates, security alerts, and account notifications
  • Detect and prevent fraud, abuse, and unauthorized activity
  • Comply with legal obligations under Philippine law

4. Legal Basis for Processing

We process your personal data based on: (a) your consent upon registration; (b) performance of a contract — to provide the payment gateway service; and (c) legal obligation — to comply with BSP regulations and applicable Philippine laws.

5. Data Sharing & Third Parties

We do not sell or rent your personal data. We may share your information with:

  • Payment processors and banking partners — solely to execute transactions
  • Government authorities — when required by law, court order, or regulatory mandate
  • Service providers — such as cloud hosting and email delivery services, under strict data processing agreements

6. Data Retention

We retain your personal data for as long as your account is active or as required by law. KYC documents are retained for a minimum of 5 years in compliance with anti-money laundering regulations. You may request deletion of non-legally-required data by contacting us.

7. Security

We implement industry-standard security measures including encrypted storage of uploaded documents, hashed passwords, HMAC-signed API communications, and access controls. However, no system is completely immune to breaches. We will notify you promptly of any data breach that materially affects your information.

8. Your Rights

Under the Data Privacy Act of 2012, you have the right to:

  • Access — Request a copy of your personal data we hold
  • Correction — Request correction of inaccurate or outdated information
  • Erasure — Request deletion of data that is no longer necessary, subject to legal retention requirements
  • Objection — Object to the processing of your personal data in certain circumstances

  • Complaint — Lodge a complaint with the National Privacy Commission (NPC)

9. Cookies

We use session cookies to maintain your login state on the merchant dashboard. We do not use tracking or advertising cookies. No cookies are placed on your customers' browsers through our hosted checkout pages beyond what is necessary for transaction processing.

10. Changes to This Policy

We may update this Privacy Policy periodically. Material changes will be communicated via email. Continued use of the Service after the effective date of changes constitutes your acceptance.
